The Gwent Deprivation of Liberty Safeguards Consortium is proposing every local authority in Gwent adopt standardised BIA and MCAA forms. This is to improve consistency and follows PC&NC v City of York Council [2013] EWCA Civ 478(opens in a new tab) and later reconfirmed in the case A Local Authority v JB | 39 Essex Chambers

The forms will be built into the WCCIS platform for electronic use (with a word document also available).

The form will be built to ensure that questions are only displayed when relevant to the decision. For example, the best interest section of the form will appear if a person has been assessed as lacking capacity to make a specific decision.

Please review the proposed BIA and MCAA forms attached and complete the surveys. Your views and feedback are important to us and will help inform the final documents.


Please note these forms are not for assessing capacity specifically in relation to a Deprivation of Liberty Safeguard. Capacity assessment forms for this are under schedule A1 and completed by the Best Interest Assessor.
