Overview

Under the Gambling Act 2005, Torfaen County Borough Council is responsible for licensing and overseeing local gambling premises, and we are required to publish a policy that sets out how we will carry out our responsibilities under the act.

Our current Gambling Act policy will cease to have effect on 30 January 2019, and we must formally adopt a revised policy with effect from 31 January 2019. In order to satisfy the specific legal requirements, we need to carry out a consultation process before we do this.


We've taken the opportunity to revise the format and content of the policy to reflect the latest guidance issued to licensing authorities by the Gambling Commission, to provide practical clarity to existing and potential licence holders, and to assist our officers to correctly apply the legal provisions of the Gambling Act 2005.

The local area profile has been refreshed and is incorporated into the draft Gambling Act 2005 Policy Statement 2019 – 2022. This profile maps local areas of concern, including actual and future emerging evidence-based risks that may impact on the licensing of gambling premises and activities. Operators are encouraged to use the profile to help inform them of specific risks in the Torfaen area prior to submitting licence applications.

Following the formal consultation process, an analysis of the responses received will be undertaken, and the results will be reported to the Licensing Committee for them to consider in October 2018. Both the report and the meeting will be open to the public.

Anyone is welcome to comment on the draft policy, and their views will be taken into account when developing a final draft policy that will be considered by full council in October/November 2018.

Dan y Ddeddf Gamblo 2005, mae Cyngor Bwrdeistref Sirol Torfaen yn gyfrifol am drwyddedu a goruchwylio eiddo gamblo lleol, ac mae gofyn i ni gyhoeddi polisi sy’n nodi sut byddwn yn ymgymryd â’n cyfrifoldebau dan y ddeddf.

Bydd ein polisi Deddf Gamblo yn dod i ben ar 30 Ionawr 2019, a rhaid i ni fabwysiadu polisi diwygiedig yn ffurfiol, i ddod i rym o 31 Ionawr 2019. Er mwyn bodloni gofynion cyfreithiol penodol, rhaid i ni ymgymryd â phroses ymgynghori cyn y gwnawn hyn.

Rydym wedi cymryd y cyfle i ddiwygio fformat a chynnwys y polisi i adlewyrchu’r canllawiau diweddaraf a gyflwynwyd i awdurdodau trwyddedu gan y Comisiwn Gamblo, er mwyn rhoi eglurder ymarferol i ddeiliaid trwydded presennol a darpar ddeiliaid, ac i gynorthwyo ein swyddogion wrth ddefnyddio darpariaethau cyfreithiol Deddf Gamblo 2005 yn gywir.

Mae proffil yr ardal leol wedi ei ddiwygio ac wedi ei ymgorffori yn Natganiad Polisi drafft 2019 – 2022 Deddf Gamblo 2005. Mae’r proffil hwn yn mapio ardaloedd o bryder, gan gynnwys risgiau gwirioneddol a rhai newydd yn seiliedig ar dystiolaeth, a allai gael effaith ar drwyddedu eiddo a gweithgareddau gamblo. Anogir gweithredwyr i ddefnyddio’r proffil i’w helpu i gael gwybod am risgiau penodol yn ardal Torfaen cyn cyflwyno cais am drwydded.

Ar ôl y broses ymgynghori ffurfiol, ymgymerir â dadansoddiad o’r ymatebion a dderbyniwyd, ac adroddir ar y canlyniadau i’r Pwyllgor Trwyddedu iddyn nhw eu hystyried ym mis Hydref 2018. Bydd yr adroddiad a’r cyfarfod yn agored i’r cyhoedd.

Mae croeso i unrhyw un wneud sylwadau ar y polisi drafft, a chymerir eu barn i ystyriaeth wrth ddatblygu’r polisi drafft terfynol a gaiff ei ystyried gan y cyngor llawn ym mis Hydref/Tachwedd 2018.
